Terms of Service
These terms apply when you download, install, or use Bebe Sleepy. By using the app you accept these terms. If you do not accept them, do not use the app.
1. The app
Bebe Sleepy is a personal sleep tracker and music companion for iPhone. It records sleep manually or by reading Apple Health. It plays sleep music through an embedded YouTube Music view. It is provided as a tool for personal organisation and is not a medical device.
2. License
The publisher grants you a personal, limited, non-exclusive, non-transferable license to use Bebe Sleepy on devices you own or control, subject to the rules of the App Store and these terms.
You agree not to copy, modify, reverse engineer, or distribute the app, except where local law gives you a right that cannot be waived.
3. Bebe Pro subscription terms
Bebe Pro is the optional paid tier that unlocks the features listed on the in-app upgrade screen. The following terms apply to the subscription.
- Title of subscription: Bebe Pro.
- Length of subscription: monthly, annual, or lifetime, depending on the plan you select at checkout.
- Price: shown on the upgrade screen at the time of purchase, in your local currency where supported by the App Store.
- Auto-renewal: monthly and annual plans renew automatically at the end of each billing period for the same length and price unless cancelled at least 24 hours before the renewal date.
- Cancellation: manage or cancel a subscription in iOS Settings, Apple ID, Subscriptions. Cancellation takes effect at the end of the current period.
- Free trials: any free trial is converted to a paid subscription at the end of the trial unless cancelled before the trial ends.
- Refunds: payment is processed by Apple and refund requests are handled by Apple at reportaproblem.apple.com, subject to Apple's policies.
- Restoration: tap Restore Purchases on the upgrade screen to restore an existing subscription on a new device signed in with the same Apple ID.
4. Medical disclaimer
Bebe Sleepy is not a medical device. The information it shows is for general wellness and personal organisation. It is not intended to diagnose, treat, cure, or prevent any disease or condition, and should not be relied on as medical advice. Talk to a qualified healthcare professional about any concern related to sleep, heart rate, or general health.
5. Apple Health
When you grant Apple Health access, the app reads sleep analysis and heart rate locally and never transmits them to the publisher. The app does not share Apple Health data with third parties. You can revoke access at any time in iOS Settings, Health, Data Access and Devices.
6. YouTube Music content
The Home tab embeds the public YouTube Music web experience. Music, video, and account features inside that view belong to YouTube and Google. Your use of those features is governed by Google's terms of service, which are independent of these terms. The publisher of Bebe Sleepy is not affiliated with, endorsed by, or sponsored by Google.
7. Acceptable use
You agree not to use Bebe Sleepy to do any of the following.
- Break the law in any jurisdiction where you use the app.
- Interfere with the app's normal operation, attempt to extract its source code, or bypass any technical protection.
- Use the app to harm, harass, or impersonate another person.
8. User content
Local playlists you create inside the app belong to you. The publisher does not access, copy, or transmit them. If you uninstall the app, the local content is removed with the app.
9. Intellectual property
The Bebe Sleepy name, logo, app design, source code, and the content created by the publisher are protected by intellectual property laws. Nothing in these terms transfers ownership of those rights to you.
10. Disclaimers and limitation of liability
The app is provided as is, without warranty of any kind, express or implied, to the maximum extent allowed by law. The publisher is not liable for indirect, incidental, special, or consequential damages, including loss of data or loss of profits, arising out of your use of the app, except where local law forbids exclusion.
The total liability of the publisher under these terms is limited to the amount you paid for the app, including subscriptions, in the 12 months before the event giving rise to the claim. If you have not paid anything, the limit is zero.
11. Termination
You can stop using the app at any time by removing it. The publisher may terminate or suspend access if you breach these terms. Sections that by their nature should survive termination remain in effect.
12. Apple's standard end user license agreement
The license you receive with the app is subject to Apple's standard end user license agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Apple is a third-party beneficiary of these terms and may enforce them against you. Apple is not responsible for the app or for any claims relating to it, including product warranty, intellectual property, or end user support, except as expressly stated in Apple's standard EULA.
13. Governing law
These terms are governed by the laws of the publisher's home jurisdiction, without regard to its conflict of law rules. Disputes will be resolved in the courts of that jurisdiction unless a mandatory consumer protection law in your country gives you a different right.
14. Changes to these terms
We may update these terms when the app changes. The updated version takes effect when posted, with a new effective date. Your continued use of the app after a change is published is acceptance of the new terms. If you do not accept a change, stop using the app.
